Minister fails to pay rentals, loses property

Deputy sheriff Moses Mafongoya confirmed obtaining a writ of execution from the High court under case number HC 9707/13 for the minister’s property at the Mutasa farm. But the serriff reportedly faced challenges in attaching the property and only managed to take away only fuel tanks. They failed to take a water tank, a Massey Ferguson tractor, plough and a Jeep Cherokee ADA 3970 which is listed on the writ of execution.

Mafongoya said the auction of the property was set for Friday in Mutare.

“We did not attach all the property that we needed. We attached 1x 16 000-litre and 1×2 000-litre fuel tanks but we could not attach other property because there were some difficulties. Tandiri of Tandiri Law chambers also confirmed the development.

This comes after RB Investments obtained a High court order in April 2014 to evict Chimene from Sendekera Restaurant located at number 15 Second Street, Mutare.

The writ of execution directed to the deputy sheriff of Zimbabwe reads: “You are required and directed to attach and take into execution the movable goods of Mandiitawepi Chimene at Sendekera Restaurant, the above mentioned defendant, of number 15 Second Street, Mutare and of the same cause to be realised the sum of $28 052-00.’’

Chimene had been renting the premises since 2008 until she was evicted for failing to pay rentals of over $20 000.
