Handing down judgement, High court judge, Charles Hungwe said the evidence against Clemence Chideme was overwhelming.

He however, acquitted his co-accused brother, Emmanuel Muturiki, who also took part in the assault that led to the death of 63-year-old Kamunda Muturiki.

As presented by the state, the facts are that on June 7 2011, Chideme who harboured ill-feelings towards his father, whom he accused of having an affair with his wife, attacked the elderly man as he slept in his bedroom.

Chideme allegedly used a wrench spanner to bash his father’s head several times. Unconvinced that he had received enough punishment for his “crime”, Chideme dragged his father to the fowl run, where he continued to bludgeon him with a wooden stick all over his body.

He further took bricks and repeatedly struck his father on the head.

As he continued with the assault, Emmanuel arrived and joined in the attack, also accusing their father of having an affair with his sister-in-law.

Later on, the pair left their father lying in a pool of blood and fled the scene. His wife Rhoda, later found him and raised alarm, but he was already dead.

A police report was made and the duo was arrested.
