Three former Zimbabwe Broadcasting Corporation (ZBC) senior managers have dragged their ex-paymasters to court seeking to register their arbitral awards as a court order, with a view to execute judgement and recover a combined $341 276.

Bright Marerwa, Nonceba Mnkandla and Shadreck Mupeni filed a chamber application on Thursday last week claiming $113 262, 33, $114 252, 33 and $113 762, 33 respectively.
According to the court papers, Marerwa was employed as head, human resources and Mnkandla as head, area administration while Mupeni was head, ICT and administration before their contracts were terminated on three months’ notice on August 11 2015.
On June 15 2016, Labour Officer, one J Likwesa, ruled in the trio’s favour and the ruling was then confirmed as an order of the Labour Court on June 28 2017 without any amendments.
“In terms of the Labour Court Order, respondent [Zbc] is supposed to pay the applicants Marerwa, Mnkandla and Mupeni] in instalments over a period of six months from July 31 2017 being the date of the ruling and thereafter at the end of every month, until the amount is fully paid,” they said.
“The respondent has not paid as per the draft ruling and did not challenge the confirmation of the draft ruling by the Labour Court. Respondent has not, in terms of section 92 C (3) (b) of the Labour Court Rules, applied for interim relief. This is not an oversight but deliberate act out of realisation that the applicant’s claim is unassailable.”
The matter is yet to be set down for hearing.
