Court throws out Chipfumbu Zimura bid

EXPELLED Zimbabwe Music Rights Association (Zimura) board member Phillip Chipfumbu has suffered a major legal setback after the High Court dismissed his application challenging resolutions adopted at the organisation’s October 22, 2025 annual general meeting (AGM). 

Chipfumbu, together with Munyaradzi Muchetu, had approached the court seeking an order to stop Zimura from registering AGM resolutions and changes to its directorship, arguing that the meeting was unlawful. 

In a ruling dated December 16, 2025, the court dismissed the application, finding it to be fatally flawed. 

The applicants, represented by Zimudzi & Associates, alleged that they were unlawfully removed from Zimura membership and claimed the AGM failed to reach the required quorum.  

They further accused Zimura, represented by Polisile Ncube-Chimhini, of attempting to register the AGM outcomes with the Registrar of Companies without following proper procedures. 

However, the court was unconvinced. 

“The application is fundamentally defective. The relief sought is unclear and incompetent,” the court ruled. 

The judge further found that Chipfumbu and Muchetu had failed to prove their case even on a balance of probabilities, effectively dismantling their challenge. 

Following the dismissal, the court ordered Chipfumbu to pay Zimura’s legal costs, dealing another blow to his bid to reclaim influence within the music rights body.
